Steps for including the electronic contract 

 

Online contracting begins with a quotation for the insurance to be purchased based on the data provided by the user, which we will use to calculate the insurance premium.


Once the user accepts the price and clicks the "contract" button, the insurance contracting process begins, which ends by entering a payment method for the insurance premium.


The contract between FIATC and the policyholder will be deemed to have been concluded at the very moment the Client makes payment of the premium. Such payment, together with ticking the relevant box, implies the intention to accept these Contracting Terms.


Once the contracting process is completed, we will send you a message by email confirming the contracting of the product you have selected, and you will receive these contracting conditions together with the general and specific conditions of the insurance taken out. FIATC will make the Contracting Terms accepted by the Client available at any time.


The policy will enter into force on the following day at 00:00 hours, unless a different effective date has been agreed in the specific conditions.
In some classes of insurance, prior to formalising the insurance contract, we must analyse the application, which will be received by the relevant department. If the application has been correctly completed, the policy will be processed.

 

Identification and correction of errors


On the contracting application screens, FIATC provides the user with navigation buttons labelled “Previous” or “Amend details”, which allow changes to be made to any errors entered.
If you detect any error in the data entered after completing the contracting process, please contact our customer service department.


 
Language


The language or languages in which the contract may be formalised are Spanish and Catalan.


 
Withdrawal


The policyholder, provided that they are a natural person acting outside any business or professional activity, will have a period of fourteen calendar days to withdraw from the contract entered into. No reason needs to be given for this purpose.
The period for exercising this right will start to run from the day on which the contract is concluded, provided that no claim has been declared.
 
This right must be exercised in writing to any of the postal or electronic addresses indicated below (and a photocopy of the National Identity Document must be enclosed with the letter for identification purposes):

If the policyholder has correctly exercised their right of withdrawal, FIATC will refund the amount of the premium actually charged.


Payment method


The prices shown on the FIATC website are final prices in euros and include the applicable taxes. FIATC makes different payment methods available to the Client: by secure payment with VISA or MasterCard debit or credit card through the virtual POS terminal and/or by direct debit.


Payment will be made through the secure payment gateway. Payment data will be encrypted and processed by the company providing the gateway service. FIATC will not store payment data. FIATC will only retain the expiry date of your card and may contact you in order to update it.


If you use our payment service through the virtual POS terminal, we will charge subsequent premiums to the card you have provided, all in strict compliance with the applicable regulations. For this purpose, we will retain only the expiry date of the card provided and may contact you to request that it be updated.

To submit a claim or complaint, whether in relation to the mediation of the insurance contract entered into or to the contract itself, you must send a written notice to the relevant postal or electronic address of the chosen or corresponding entity, as indicated above. A photocopy of your National Identity Document must be enclosed with the written notice for identification purposes.


From the moment the claim or complaint is submitted to the relevant Department or Service, that body will have a period of one month in which to process it and issue a final decision. The time limit for issuing a decision shall be suspended if the identity of the complainant is not sufficiently proven or if the facts giving rise to the claim or complaint cannot be clearly established.


In the event of disagreement with the outcome issued, or in the absence of a decision within the period indicated above by the aforementioned bodies, the client–complainant may submit their claim or complaint to the COMMISSIONER FOR THE PROTECTION OF FINANCIAL SERVICES CLIENTS, which reports to the General Directorate of Insurance and Pension Funds, with its registered office at Paseo de la Castellana, no. 44, 28042 Madrid.


The FIATC Client Protection Regulations govern the internal procedure for submitting and resolving claims and complaints. If you so wish, you may obtain a copy via the FIATC website or at any of its offices.


Insurance and mediation supervision


FIATC has its registered office in Spain, and the supervision of its activities falls under the responsibility of the General Directorate of Insurance and Pension Funds.

 

Law and applicable jurisdiction


In relations between FIATC and the Client arising from the contracting of products offered at www.fiatc.es, Spanish law shall apply, with the parties expressly submitting to the jurisdiction of the courts of Barcelona, unless the applicable regulations confer jurisdiction on a different court.
